Today the Corporate Manslaughter Act took effect in England and is already hailed as landmark legislation in UK law.
Any company can now be prosecuted under the Corporate Manslaughter Act as a result of a serious failure which results in a gross breach of the company (and its' Directors) duty of care.
If a company is found guilty it could be fine as much as 10% of its annual turnover. In addition to unlimited fines, it is now possible for the courts to issue a publicity order, forcing publication of details of the conviction and any fine imposed by the courts.
